This website is operated by Lashpot. Throughout the site, the terms “we”, “us” and “our” refer to Lashpot. Lashpot offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time.

We are not responsible if information made available on this site is not accurate, complete or current. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

In no case shall Lashpot, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Lashpot and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

LASH APPOINTMENTS:

BOOKING:

You will receive text and email notifications when an appointment is booked, 24 hrs before your appointment and in the event of a reschedule, cancellation or no show. The emails contain important information so please check your emails. Update me of any change to your phone number or email so that I can make sure you receive notifications.

BOOKING FEES:

Booking fees go towards the total cost of your treatment. This means that the amount of booking fee that you pay will be deducted from the total price when you attend your treatment appointment. Booking fees are completely non-refundable and non-transferable with less than 48hrs notice to reschedule or more than 3 reschedules. If you are unable to reschedule, or you cancel or no show then you will lose your booking fee and need to pay a new booking fee to rebook.

PREPARATION:

Please stop using oily products on/near your eye area for AT LEAST a good few days before your appointment. Oil can’t always be entirely removed from just one wash and can prevent the lash glue from curing properly as well as breaking it down. Please see my work @lashpotuk on insta for inspo and show some love! The address will be emailed to you. 

APPOINTMENT DAY:

On the day of your appointment don’t drink coffee/alcohol, remove all eye make up, have clean lashes and use the toilet just before you come. You will need to remove contact lenses. Please use my drive, NOT the private parking area to the left of my house. Booking fees are completely non-refundable and non-transferable with less than 48hrs notice to reschedule or more than 3 reschedules. If you are unable to reschedule, cancel, no show or are late you will lose your booking fee and need to pay a new booking fee to rebook.

RUNNING LATE:

If you reschedule due to running late for your appointment then I apologise for any inconvenience caused through rescheduling. I often have back to back appointments so it isn’t always possible to run late because I may not have time for your treatment. Thank you for your understanding.

CANCELLATIONS:

Booking fees are non refundable in the case of cancellation. If you cancel due to running late for your appointment and being unable to reschedule then I apologise for any inconvenience caused through cancelling. NO SHOWS:

If you don't show up to your appointment, I do hope that everything is okay, please do let me know. Booking fees are non-refundable in the case of no shows.

GDPR:

To comply with GDPR I need to inform you of how I hold your data and ask your permission to use it. Previous paper consent forms are stored in a locked case. This consent form will be stored on this password protected iPad. I will also need to take photographs to document treatment progress, some of which may be used for advertising/educational purposes. I will continue to hold your data securely and not pass on or sell your data to third parties. It will only be kept by me for as long as necessary. If you wish me to make any changes to your records please advise me. Please sign this document if you are happy for me to continue with all of the above.

REFUNDS:

I operate a strict no refund policy on lash extension services but if you experience any issues with your lashes within 4 days please message me within those first 4 days and I will be more than happy to help. Lash extension retention relies on good aftercare so please read your aftercare card ASAP.

LASH EXTENSIONS:

If you have lash extensions on but do not qualify for an infill this is charged as a full set. This includes the removal of ONLY the outgrown lash extensions. If you would like all of your remaining lash extensions removed before having a full set then please book a removal aswell.

If you come for your appointment wearing eye make up/strip lash glue or have unclean lashes/haven't washed your lashes then you may be charged for a lash bath, the cleaning time may take away from your lash application/treatment time, you may have a less full set of lashes or we may have to reschedule or cancel, in which case your booking fee would not be refunded or transferred and the full treatment cost may still be due.

No set of lashes looks exactly the same from one client to the next because our faces, eyes and lashes are all different. Inspo photos are welcomed and I'll do my best to achieve the look you want but we need to have realistic expectations. Photos with lash maps can help but without knowing that persons eye and lashes before extensions, the lash map may still not achieve the same look for you.

If you have lash extensions on from another lash tech then please book a removal before the full set

Previous lash lifts need to be grown out before you can book for lash extensions.

If you are booking in with me for the first time/it’s been a long while since you did/you are trying a new treatment, please make sure that you also book a patch test for at least 48hrs before your treatment.

I know patch tests can seem inconvenient, but so is having an allergic reaction. They only take a few mins (if that) so it’s better to be safe, especially when it comes to your eyes.

Patch tests are also a good opportunity for us to meet each other and for you to see where your appointment will be.

LASH EXTENSIONS AFTERCARE:

For the 1st 24HRS don’t: use hot tubs, saunas, tanning beds or gyms (use of these after 24hrs can still impact the life of your lash extensions)

Don’ts: cluster/strip lashes, mascara, hard to remove eye make up, oil based products, make up wipes, eyelash curlers, perms, tints, rubbing, picking pulling, sources of heat and naked flames

Do daily: brush, remove makeup, wash with lash cleanser and brush, rinse, air dry/pat dry, brush again after drying, sleep on back, use satin pillowcase/eye mask, 3D eye mask

 do not recommend cleaning your eyelashes or eye area with anything other than a lash cleanser using an appropriate brush and rinsing them thoroughly. I supply you with lash cleanser and a brush in your free aftercare kit with your first set of lash extensions along with instructions and cleanser refills are available.

Aftercare must be followed for you to get the best retention and keep your natural lashes healthy. Aftercare is available on my booking system for each service listing, the consultation form that you read and sign on your first appointment, the aftercare card that I give you with your free aftercare set with your first set of lash extensions, on the website and on the Instagram and story highlights.

Infills are at 2-3wks only (50% extensions must also remain), 3+ weeks will be considered a full set because remaining lash extensions will be growing out and can damage your natural lashes if they are left too long. Removal must be done by a professional to avoid any damage.

LASH EXTENSION INFILLS:

You must wash your lashes with lash shampoo just before you attend your appointment.

If you come for an infill wearing mascara/strip lash glue it won't be considered an infill, you will be charged for a removal AND a full set.

Infills are at 2-3wks only (at least 50% extensions must also remain even if you're booking before 3 weeks), 3+ weeks will be considered a full set because remaining lash extensions will be growing out and can damage your natural lashes if they are left too long.

When in this 2 to 3 week time frame you return for an infill will be determined by your level of aftercare and how quickly your natural lashes shed and grow out. For some people this does mean infills are necessary at 2 weeks. This is something that I can advise you on after your first infill when I can see your lash retention. Lash techs can often tell a lot about the level of aftercare and the speed of your lash cycle just by looking. Sometimes we naturally experience a quicker shed but after a few infills we will find out what is normal for you. We expect a quicker shed as we change seasons which can last a couple of infills so booking more frequent infills than normal during this time can keep this under control. If you have booked an infill but suspect that you've less than half of your lash extensions remaining and not outgrown then please let me know before your appointment and send a clear photo of your lashes from above so that I can make sure that we have enough time as this would then be classed as a full set and charged accordingly.

It is not always possible to achieve a completely different style of lashes at each infill. This is because an infill only consists of replacing outgrown lashes and filling in gaps so any lash extensions that are remaining will somewhat determine the look. Depending on what lash extensions you have remaining and what change in style you wish to achieve I can start to transition your lashes to a new style but it may take a few infills before it is possible. If you would like an immediate change in style then you would need to book a removal and a full set.

I do not infill other lash techs work. If you have lash extensions by another lash tech you will need to book a patch test, removal and full set. Sorry for any inconvenience.

LASH LIFT & TINTS:

It must have been at least 8 to 10 weeks since any previous lash lift and the lash lift must be outgrown, for some people this may take longer. If you are unsure you can send me some close up photos of your lashes. If you have lash extensions on please book a removal as well, I will need time to remove them before performing the Lash Lift & Tint. As per manufacturer’s guidelines, I cannot perform a Lash Lift & Tint if you are pregnant. Lash extensions are a safe alternative for during pregnancy. If you are booking in with me for the first time/it’s been a long while since you did/you are trying a new treatment, please make sure that you also book a patch test for at least 48hrs before your treatment.

LASH LIFT & TINT AFTERCARE:

For the 1st 24-48hrs don’t: rub eyes, wear contact lenses, wet eyes, wear make-up, receive any other eye treatments, swim, use sauna

Do: use a lash conditioner daily (IF YOU ARE HAVING REGULAR LASH LIFTS I RECOMMEND INVESTING IN A SERUM WHICH I DO SELL) , comb lashes upwards using a spoolie, sleep on your back

With a lash lift, the perm grows out gradually until each lash sheds naturally as part of our normal lash cycle. This lash cycle can vary in speed due to many different factors. Towards the end of the lash lift period this can mean that lashes appear a little messy as each lash is in a different stage of growth, the perm is no longer in a neat line and the newly grown lashes will be straight. This can be more obvious with a dramatic lash lift. Using a daily lash serum can help speed up this stage and also keep the lashes from appearing dry.

MORE INFORMATION:

If you experience sensitive or watery eyes during your appointment I will do my best to work with this and good retention can still be achievable although not guaranteed. If poor retention is experienced as a result of this you may just not be a good candidate for future lash extensions or treatments.
